I believe you have misinterpreted the rule. That rule was for the initial draft. Here is the rule we've always gone by for the beginning of each year.
3) Cumulative team records will determine the divisional assignments for Season 1 of each new year.

Correct. It can also be read as draft order for the Free Agent draft determines divisions. Draft positions 1-4 are in the East, 5-8 Central and 9–12 the west.

Got it, I didn't read the next line down in the rules

When I read cumulative I think all-time, but I think prior year cumulative is better otherwise we could be stuck with the same divisions more frequently.
